Terms of Use

Please read these Terms of Service (“Agreement”) completely for EverythingBlueCollar.com (“Website”) which is owned and operated by Everything Blue Collar, LLC. (“Company”).  This Agreement documents the legally binding terms and conditions attached to the use of the Website. If you choose to use the Website, you agree to our Terms of Use defined here.

By using or accessing the Website in any way, viewing or browsing the Website, or adding your own content to the Website, you are agreeing to be bound by these Terms of Use.

Intellectual Property

The Website and all of its original content are the sole property of the Company and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws.

Violations

We strive to monitor the content of the website, and we accept feedback from members that see something on the website which they believe is in violation or suspected violation of our policies. Any violation or suspected violation of our policies shall be reported to us using the Violations Reporting page. The Violations Reporting page allows any member to report a suspected violation of our policies, describe the violation, identify the policy or polices suspected of being violated, and the URL to the suspected content.

Violation Investigation

Once we are notified of suspected policy violations by a member (or members), an email will be sent to the member (or members) informing them that an investigation has been initiated to address the reported violation. A staff member will be assigned (“investigator”) to investigate the reported violation and will send a follow-up email announcing their involvement.

The suspected content may remain visible on the website or made unavailable on the website as determined by the nature of the suspected violation. An identifier (a flag, an image, or text warning) may be added to the content to notify members a reported violation investigation is underway.  

If the suspected content is removed from visibility on the website, the member responsible for posting the content may submit a response to the investigator to appeal the removal.

Once the investigation has concluded, the final assessment and status of the content will be sent by email to the member (or members) identified as originating the suspicious content. If it is determined that the member (or members) have been in violation of our policies, their account(s) will be terminated as per our Terms of Use policy (Termination clause).

An email will be sent to the member that reported the violation, informing them of the final assessment and actions taken.

If the content has been deemed acceptable, it will be made visible on the website. An identifier (a flag, an image, or text) may be added to the content to identify the content has been reviewed and is compliant with our policies.

If multiple members (“reporters”) submit the same content of suspected violations of policies, a single investigator will handle all reports as a single report. The investigator will send an email to all reporters informing them of the initiation of the investigation. All reporters will be notified of the final assessment at the conclusion of the investigation.

Termination

The Company reserves the right to terminate your access to the Website, without any advance notice.

We reserve the right to close an account due to violations of our policies or violating the use of our services. The member will be notified by email and will be provided with an explanation as to why their account has been closed by us.

The terminated account profile information will no longer be visible to other members, and any content retained may be visible to other members as determined by us. Any reference to the profile will be replaced with a reference to “unknown user”.

Links to Other Websites

Our Website contains one or more links to other websites and online resources that are not owned or controlled by the Company.

The Company has no control over, and therefore cannot assume responsibility for, the content or general practices of any of these third-party sites and/or services. Therefore, we strongly advise you to read the entire terms and conditions and privacy policy of any site that you visit after following a link that is posted on our site.

Governing Law

This Agreement is governed in accordance with the laws of Colorado, United States.

Changes to This Agreement

The Company reserves the right to modify these Terms of Use at any time. We will post the updated Terms of Use on the website with an updated effective date. An online notification, and if necessary, an email notification, will announce the updated Terms of Use. Your decision to continue to visit and use the Website after such changes have been made constitutes your formal acceptance of the new Terms of Use.

Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the Website immediately.
